Terms of Service

Planthead is operated by MB Augalistas, a small partnership (mažoji bendrija) registered in Lithuania, registration number 307961595, registered address Girulių g. 10-201, Vilnius, LT-12112, Lithuania ("Planthead", "we", "us"). You can reach us at marius@planthead.app.

• You must be at least 13 years old to use Planthead. If you are under the age of majority in your country, you confirm that a parent or guardian agrees to these Terms on your behalf.
• Planthead is not intended for children under 13, and we do not knowingly collect their data.
• You are responsible for keeping your account credentials secure and for all activity under your account.

• You agree to provide accurate information when creating an account.
• You may control the visibility of your profile (public or private) in your settings.
• You may delete your account at any time from within the app (Profile → Settings → Delete Account). Deleting your account permanently removes your profile, plants, posts, comments, uploaded photos, and associated personal data, except limited information we may retain where legally required.

Planthead is built to be kind, calm, and welcoming. You agree NOT to:

• post content that is hateful, harassing, threatening, discriminatory, or that attacks people based on protected characteristics;
• bully, intimidate, dox, impersonate, or stalk other users;
• post sexual or explicit content, graphic violence, or content that endangers or sexualizes minors;
• post spam, scams, fraudulent giveaways, or misleading commercial content;
• upload content you don't own or have permission to share;
• post dangerous misinformation, malware, or links to harmful material;
• attempt to break, overload, scrape, reverse-engineer, or gain unauthorized access to the Service;
• use the Service to violate any applicable law.

Our Community Guidelines are part of these Terms, and the same rules apply throughout the Service.

• You keep ownership of the content you create and upload (plants, photos, posts, comments, profile info).
• By posting content, you grant Planthead a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely to operate and provide the Service (for example, showing your public posts in other users' feeds). This license ends when you delete the content or your account, except for content others have already saved or copies retained for backups or legal reasons.
• You are responsible for the content you post and confirm you have the right to share it.

• We may remove content, hide posts, restrict, suspend, or terminate accounts that violate these Terms or our Community Guidelines, or that harm the community or the safety of the platform.
• You can report content or users from within the app. We review reports but cannot guarantee any specific outcome or response time.
• Moderation decisions are made to protect the health of the community.

• Planthead offers AI-assisted plant identification, care suggestions, and short plant descriptions. These are generated automatically and are provided for general informational purposes only.
• AI results may be inaccurate or incomplete. You should use your own judgment and independent research for plant care. We do not guarantee identification accuracy, plant health outcomes, or plant survival. (See our Plant Identification & Care Disclaimer.)

• Planthead offers an optional paid subscription ("Premium") unlocking features such as unlimited custom shelves and additional perks. Free features remain available without payment.
• Pricing and what's included are shown in the app and may change over time; we'll give reasonable notice of material changes.
• Billing. Subscriptions are billed through the payment provider shown at checkout (for example, Apple App Store, Google Play, or another supported provider). Payment, renewal, and cancellation are handled according to that provider's terms.
• Renewal & cancellation. Subscriptions renew automatically unless cancelled before the renewal date. You can manage or cancel your subscription through your payment provider's settings. Deleting the app does not cancel a subscription.
• EU right of withdrawal & refunds. If you are an EU consumer, you may have a statutory right to withdraw from a purchase within 14 days, subject to exceptions for digital content you've agreed to access immediately. Refunds for app-store purchases are generally handled by the relevant app store.

• We work to keep Planthead running smoothly, but we provide the Service "as is" and "as available". We don't guarantee it will always be uninterrupted, error-free, or that data will never be lost.
• We may change, suspend, or discontinue features at any time.

To the maximum extent permitted by applicable law, Planthead is not liable for indirect, incidental, or consequential damages, or for loss of data, plants, or profits arising from your use of the Service. Nothing in these Terms limits rights that cannot be limited under applicable law, including mandatory consumer protections under Lithuanian and EU law.

Your use of Planthead is also governed by our Privacy Policy and Data Collection & Privacy Declaration, which explain what data we collect and how we use it. We do not sell your personal data.

We may update these Terms from time to time. If we make material changes, we'll notify you through the app or website. Continuing to use Planthead after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the Republic of Lithuania. Mandatory consumer-protection rights you have as an EU/Lithuanian consumer remain unaffected. Disputes will be handled by the competent courts of Lithuania, subject to any consumer rights to bring proceedings in your own country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform.
